Terms & Conditions
Please read these terms before using the Malarikkal Boat Booking website or requesting any local service.
Last updated: 09 September 2026
1. Nature of the platform
Malarikkal Boat Booking, operated through malarikkalboats.com, is an online booking, information, and communication platform for visitors interested in Malarikkal boat ride experiences at Kottayam, Kerala. The platform helps customers submit booking requests and helps admins coordinate with independent local boat operators and add-on providers.
The website owner, administrator, technology provider, and platform team do not own, operate, manage, supervise, or control the boats, water bodies, tourism location, routes, weather conditions, photography services, drone services, food services, or field operations unless expressly stated in writing.
2. Acceptance of terms
By using this website, submitting a booking request, contacting an operator, making a payment, uploading information, or accessing an admin/operator account, you agree to these Terms & Conditions. If you do not agree, do not use the website or services.
3. Role as intermediary
The platform's role is limited to receiving booking requests, displaying information, coordinating initial communication, recording booking/admin updates, and assigning available independent providers where applicable. The platform does not guarantee that any independent operator or provider will accept, perform, or complete a service.
Any ride operation, customer handling, route selection, timing, safety practice, fare representation, add-on delivery, and local compliance remains the responsibility of the assigned independent operator or provider.
4. No agency or employment relationship
Boat operators, drivers, photographers, drone videographers, breakfast providers, and other local service providers are independent parties. They are not employees, agents, partners, franchisees, or representatives of the website owner/admin. The website owner/admin does not control their schedules, fares, equipment, licensing, conduct, professionalism, boat condition, routes, duration, or service quality.
5. Customer responsibility
Customers must provide accurate names, phone numbers, email addresses, visit dates, passenger counts, and add-on requests. The platform is not responsible for failed communication, missed rides, incorrect allocation, payment issues, or service problems caused by wrong or incomplete information.
Customers are responsible for checking weather, health, mobility, age, swimming ability, personal safety, local travel restrictions, and suitability before choosing a boat ride or add-on service. Customers must verify the identity, credentials, safety equipment, and trustworthiness of any operator/provider before participating or making direct arrangements.
6. Availability and assignment
Booking confirmation, boat assignment, route, timing, and add-on availability depend on operator acceptance, local conditions, capacity, weather, safety restrictions, seasonality, and administrative approval. A booking request does not guarantee a specific boat, operator, route, time slot, photographer, videographer, or drone service.
7. Operator and add-on provider responsibility
Independent boat operators and add-on providers are responsible for their own licenses, permissions, equipment, staff, safety procedures, conduct, pricing representations, quality of service, local-law compliance, and customer handling. The platform may help coordinate assignments but does not control day-to-day field operations.
8. Safety and assumption of risk
Boat rides involve natural water bodies and outdoor conditions. Water level, rain, wind, heat, visibility, road access, crowding, government instructions, and local events may affect service. Customers must follow operator safety instructions, wear required safety equipment when provided, and avoid unsafe conduct.
Water-based tourism involves inherent risks, including injury, drowning, capsizing, illness, loss of property, delays, cancellations, and emergency conditions. By participating, customers voluntarily assume these risks to the maximum extent permitted by law.
The website owner/admin is not liable for personal injury, death, illness, accident, theft, property damage, loss, delay, disappointment, missed photography opportunity, weather impact, natural event, third-party negligence, or force-majeure event to the maximum extent permitted by law.
9. Payments, cancellations, and refunds
Payment collection, refund eligibility, cancellation charges, rescheduling, and settlement may vary depending on the selected operator, payment method, seasonal demand, and administrative rules shown at the time of booking or communicated later. Bank, payment-gateway, and third-party charges may be non-refundable.
Unless the platform expressly states that it collected and controls a payment, all direct negotiations and transactions with operators/providers are strictly between the customer and that independent party. The website owner/admin is not responsible for overcharging, non-delivery, fraud, refund disputes, cash transactions, or payment-gateway/bank delays caused by third parties or incorrect customer payment details.
10. Pricing information
Any fare, package, seasonal, or add-on price displayed or communicated through the platform is indicative unless clearly confirmed for a specific booking. Actual charges may vary based on date, time, passenger count, boat type, route, duration, provider availability, peak demand, and local conditions.
11. User conduct
Users must not submit false bookings, misuse contact details, harass operators, upload harmful content, attempt unauthorized access, scrape data, disrupt the website, impersonate others, or use the platform for illegal activity. The admin may suspend, reject, cancel, or restrict access without prior notice if misuse is suspected.
12. Content, intellectual property, and user submissions
Text, design elements, software, images, graphics, and other platform content belong to the platform owner or respective content providers and may not be copied, modified, distributed, or commercially used without permission.
By submitting messages, reviews, photos, registration details, or other content, you confirm that you have the right to submit it and grant the platform a non-exclusive permission to use it for operating, supporting, improving, and promoting the service, subject to applicable law.
13. Information accuracy and seasonal conditions
Website content, images, route descriptions, timings, prices, add-on details, and tourism information are provided for general guidance. They may change without notice. Natural attractions such as water lilies are seasonal and cannot be guaranteed.
Bloom conditions, sunrise visibility, weather, water levels, access roads, and local restrictions may differ from website descriptions or historical expectations.
14. Third-party links and services
The website may link to or integrate with Google Maps, WhatsApp, payment gateways, social media platforms, hosting providers, analytics tools, email/SMS services, and other third-party services. Their terms, privacy policies, uptime, fees, and failures are outside the platform's control.
15. No warranty
The platform is provided on an "as is" and "as available" basis. No warranty is given regarding uninterrupted access, error-free operation, accuracy, availability, safety, legality, suitability, merchantability, or fitness for a particular purpose.
16. Limitation of liability
To the maximum extent allowed by applicable law, the website owner, admin, developers, technology provider, affiliates, and representatives shall not be liable for indirect, incidental, special, punitive, consequential, or business losses, including loss of data, profit, travel cost, enjoyment, reputation, or opportunity.
Where liability cannot be fully excluded, the maximum aggregate liability of the website owner/admin for any claim related to the platform shall be limited to the platform service fee actually received by the website owner for the relevant booking, if any.
17. Indemnity
You agree to defend and hold harmless the website owner, admin, technology provider, and representatives from claims, losses, penalties, costs, or expenses arising from your misuse of the website, violation of these terms, false information, unlawful conduct, dispute with an operator/provider, or breach of third-party rights.
18. Age restriction
The website is intended for users who are 18 years or older. Minors may use the website or participate in services only with the consent and supervision of a parent or legal guardian.
19. Governing law and jurisdiction
These terms are governed by the laws of India, including applicable provisions of the Information Technology Act, 2000 and the Indian Contract Act, 1872. Subject to applicable law, disputes shall fall under the jurisdiction of competent courts at Kottayam, Kerala, India.
20. Severability
If any part of these terms is found invalid or unenforceable, the remaining parts will continue to apply to the fullest extent permitted by law.
21. Changes to terms
These terms may be updated from time to time. Continued use of the website after updates means you accept the revised terms.
